Terms and Conditions

Australia Property is an online property research and information platform that aggregates, models, and presents suburb-level data, property listings, investment signals, and related tools to assist users in their property research. The Platform is intended for general informational and research purposes only.

Nothing on the Platform constitutes financial product advice, investment advice, legal advice, taxation advice, or any other professional advice within the meaning of the Corporations Act 2001 (Cth) or any other applicable law. We are not a licensed financial services provider under the Corporations Act 2001 (Cth) and do not hold an Australian Financial Services Licence (AFSL).

All content, data, scores, indices, rankings, yield estimates, growth estimates, and any other information displayed on the Platform ("Content") is provided for general informational purposes only. You must not rely on any Content as the sole or primary basis for any investment, financial, legal, or other decision. Before making any property investment or financial decision you should obtain independent advice from a qualified and licensed financial adviser, mortgage broker, solicitor, or other appropriate professional.

The Platform displays a combination of:

• Real data sourced from publicly available datasets including the Australian Bureau of Statistics (ABS) Census 2021, the Australian Taxation Office (ATO) Taxation Statistics, data.gov.au, and third-party APIs; and
• Modelled estimates including but not limited to rental yield, annual growth rate, 5-year and 10-year compound annual growth rate (CAGR), net yield estimates, suburb scores, and investment indices. These estimates are generated using statistical models based on long-run state-level averages derived from REIA and CoreLogic historical data and are not sourced from live market feeds.

Modelled estimates are clearly labelled as "est." or "estimated" throughout the Platform. Modelled estimates do not represent current market conditions, guaranteed returns, or actual historical performance of any specific suburb or property. Actual market outcomes may differ materially from the estimates displayed.

We make no representation or warranty, express or implied, as to the accuracy, completeness, currency, reliability, or fitness for purpose of any Content on the Platform. We reserve the right to update, correct, or remove Content at any time without notice.

To access most features of the Platform you must create an account. By registering you represent that:

• you are at least 18 years of age;
• you are an individual or are authorised to act on behalf of a legal entity;
• you are resident in Australia or are accessing the Platform in compliance with the laws of your jurisdiction; and
• all information you provide during registration is accurate and current.

You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at legal@australiaproperty.com.au if you suspect any unauthorised access to your account. We are not liable for any loss arising from unauthorised use of your account.

The Platform offers a free tier and a paid Premium subscription. Premium subscription features, pricing, and billing cycles are set out on the Pricing page. By subscribing to a Premium plan you authorise us to charge your nominated payment method on a recurring basis at the applicable subscription rate.

All prices are displayed in Australian dollars (AUD) and are inclusive of GST where applicable. We reserve the right to change subscription fees at any time. We will provide at least 30 days' advance notice of any price increase via the email address associated with your account.

Refunds are provided in accordance with applicable Australian Consumer Law. Subscription fees are generally non-refundable for the current billing period except where required by law.

Payment processing is handled by Stripe. By providing your payment details you also agree to Stripe's terms of service. We do not store your full payment card details.

You agree not to:

• use the Platform for any unlawful purpose or in breach of any applicable law or regulation;
• scrape, harvest, or systematically extract data from the Platform by automated means without our prior written consent;
• reproduce, distribute, publish, or commercially exploit any Content without our prior written consent;
• attempt to gain unauthorised access to any part of the Platform or its underlying systems;
• upload or transmit any malicious code, virus, or other harmful material;
• use the Platform to harass, harm, or deceive any other user or third party; or
• circumvent or disable any access controls, security features, or subscription gates on the Platform.

We reserve the right to suspend or terminate your account immediately if we reasonably believe you have breached any of these conditions.

All intellectual property rights in the Platform, including its design, software, algorithms, scoring models, and Content created by us, are owned by or licensed to Australia Property Pty Ltd. Nothing in these Terms grants you any right, title, or interest in our intellectual property other than a limited, non-exclusive, non-transferable licence to access and use the Platform for your personal, non-commercial research purposes.

Publicly sourced datasets (ABS, ATO, data.gov.au, etc.) remain the property of their respective owners and are subject to their own licensing terms.

We collect and handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. By using the Platform you consent to the collection and use of your personal information as described in our Privacy Policy (available at /privacy). Key points include:

• We collect your name, email address, role, and usage data when you register and use the Platform.
• We use this information to provide, personalise, and improve the Platform and to communicate with you about your account and subscription.
• We do not sell your personal information to third parties.
• We use Stripe for payment processing and may share limited data with Stripe for this purpose.

The Platform may contain links to third-party websites, data sources, and services. These links are provided for convenience only. We do not endorse, control, or take responsibility for the content or practices of any third-party websites or services. Your use of third-party services is at your own risk and subject to their respective terms and privacy policies.

To the maximum extent permitted by law:

• the Platform and all Content are provided on an "as is" and "as available" basis without any warranty of any kind;
• we expressly disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement;
• we are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of or inability to use the Platform, including any loss of profits, loss of data, or financial loss resulting from reliance on any Content; and
• our total aggregate liability to you for any claims arising under or in connection with these Terms shall not exceed the total subscription fees paid by you in the 12 months preceding the claim.

Nothing in these Terms limits any rights you may have under the Australian Consumer Law that cannot be excluded by contract, including any applicable consumer guarantees.

You agree to indemnify, defend, and hold harmless Australia Property Pty Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Platform, your breach of these Terms, or your violation of any applicable law or the rights of any third party.

We reserve the right to modify, suspend, or discontinue the Platform (or any part of it) at any time with or without notice. We also reserve the right to update these Terms at any time. When we make material changes we will update the effective date at the top of this page and, where appropriate, notify you by email. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

We may terminate or suspend your account and access to the Platform at any time without prior notice if we reasonably believe you have breached these Terms or for any other reason at our sole discretion. You may cancel your account at any time by contacting us at legal@australiaproperty.com.au. Upon termination, your right to use the Platform ceases immediately.

These Terms are governed by the laws of New South Wales, Australia, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising under or in connection with these Terms, subject to any mandatory rights you may have under applicable Australian law.

We encourage you to contact us in the first instance to resolve any dispute informally. Most concerns can be resolved quickly by emailing us at legal@australiaproperty.com.au.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy and any applicable subscription agreement, constitute the entire agreement between you and us with respect to your use of the Platform and supersede all prior agreements and understandings.
